VanBuild360 Online Listing Agreement
This Online Listing Agreement (“Agreement”) is made between the user (“Builder”) and VanBuild360 (“Platform”), operating out of California, collectively referred to as the “Parties.”
Acceptance of Agreement: By using the listing services provided by VanBuild360 and checking the “I Agree” box on the Platform’s registration page, the Builder acknowledges having read, understood, and agreed to be bound by this Agreement.
1. Services Provided The Platform shall provide the Builder with listing services corresponding to the selected membership plan (Free Plan, Pro Plan, or Pro Plus Plan). Services include listing the Builder’s company information and categorizing it by region, along with potential additional visibility enhancements through purchased add-ons.
2. Performance Expectations The Platform facilitates visibility among potential customers interested in van builds but does not guarantee specific performance metrics such as a certain number of leads or conversions. Builder performance may vary based on market conditions, the quality and completeness of the Builder’s listing, and audience engagement.
3. Fees and Payment Builder agrees to pay the fees associated with their selected membership plan and any additional add-ons according to the Platform’s current pricing schedule. Payment is due upon registration and on each renewal date thereafter unless otherwise specified.
4. Term and Termination This Agreement is effective upon the Builder’s acceptance and continues in effect until terminated by either party. Either party may terminate this Agreement with a 30-day written notice.
5. Privacy and Data Protection The Platform commits to not selling the Builder’s personal information to third parties. By providing personal details to the Platform, the Builder consents to their use for purposes of promotion and visibility on the Platform. Builders are responsible for maintaining the accuracy and integrity of their provided information.
6. Limitation of Liability The Platform shall not be liable for any indirect, incidental, or consequential damages arising from the use of the services provided under this Agreement.
7. Indemnification The Builder agrees to indemnify and hold harmless the Platform from any claims, losses, damages, liabilities, including legal fees and expenses, arising out of their use of the services.
8. Miscellaneous This Agreement constitutes the entire agreement between the parties regarding its subject matter. Any amendments to this Agreement must be made in writing and signed by both parties.
9. Governing Law This Agreement shall be governed by the laws of the State of California, without regard to its conflict of law provisions.
By using the listing services of VanBuild360, the Builder consents to and agrees to abide by the terms set forth in this Agreement.
